Planning Scheme Amendment C115 rezoned approximately 10.1Ha of Farming Zone (FZ) land within the North Sale Growth Area to the General Residential Zone - Schedule 1 (GRZ1) (see below).
The Amendment has been made under the provisions of Section 96A of the Planning and Environment Act 1987, which allows a concurrent planning permit application to be considered alongside the rezoning request. As such, consent to subdivide the land into 82 residential allotments averaging approximately 700m2 was also granted (see Figure 2).
The land in question is vacant agricultural land bordering Glenhaven Estate to the east, the Main Sale Irrigation Channel to the North, the Gippsland Railway Line to the west and Rural Living lifestyle allotments to the south.

At the Ordinary meeting of 21 June 2022, Council resolved to seek Authorisation from the Minister for Planning (the Minister) to prepare and formally exhibit Planning Scheme Amendment C115 and the concurrent planning permit application.
Authorisation from the Minister for Planning was granted on 26 October 2022.
The Amendment and concurrent planning permit application for subdivision was publically notified between 1 December 2022 and 20 January 2023.
Council adopted Planning Scheme Amendment C115 and the concurrent planning permit application on 7 March 2023. The Minister for Planning approved the Amendment (rezoning) and combined planning permit application for subdivision, effective from 11 May 2023.
