Amendment C109wellPt1

Current Status

The Minister for Planning has approved Amendment C109wellPt1 to the Wellington Planning Scheme. The changes came into effect on Thursday 4 May 2023.

Background – Split Amendment

Wellington Amendment C109well, as exhibited, proposed to delete Schedule 1 to the Environmental Significance Overlay (ESO1) from the residential areas in Golden Beach, Paradise Beach and the Honeysuckles.

At the ordinary Council Meeting of 4 October 2022, Council voted to split Planning Scheme Amendment C109 into two parts (C109wellPt1 and C019wellPt2), being:

  • Part 1 - All parts of the exhibited Amendment - except the proposed deletion of Schedule 1 to the Environmental Significance Overlay (ESO1) from the residential areas in Golden Beach, Paradise Beach and the Honeysuckles.
  • Part 2 - Proposed deletion of Schedule 1 to the Environmental Significance Overlay (ESO1) from the residential areas in Golden Beach, Paradise Beach and the Honeysuckles.

C109wellPt1 has now been formally approved, while C019wellPt2 has been abandoned.

What is Amendment C109wellPt1?

Planning Scheme Amendment C109wellPt1 has facilitated a comprehensive restructure of the Wellington Planning Scheme (Planning Scheme) and includes minor revisions to some zone and overlay provisions to help reduce red-tape and make some types of new (minor) development such as sheds, easier.

The Amendment was a ‘mandated’ State Government requirement under the ‘Smart Planning’ program that applies to all planning schemes across Victoria to ensure state-wide consistency in how they are presented.

The Amendment has resulted in a new look, streamlined Planning Policy Framework (PPF), which integrates state, regional and local planning policy into a more succinct and user-friendly structure.

Key changes

Amendment C109wellPt1 has made the following key changes to the Wellington Planning Scheme:

  • Replaces the Municipal Strategic Statement and the Local Planning Policy Framework of the Wellington Planning Scheme with a Municipal Planning Strategy and Planning Policy Framework;
  • Implements the recommendations of reports that underpin the Planning in the Economic Growth Zone project;
  • Updates several schedules to the zones, overlays and operational provisions to be consistent with the Ministerial Direction on Form and Content; and
  • Revises several zone and overlay schedules to remove permit triggers, introduce permit exemptions, and improve wording and efficacy of provisions.

Amendment C109wellPt1 provides a more concise Planning Scheme that is easier to navigate and administer and will deliver a greater level of certainty to the community and other stakeholders.
