At the ordinary meeting of 17 March 2026, Council resolved to seek written consent from the Minister for Planning to formally commence Draft Planning Scheme Amendment C125well – updated flood provisions.  

Upon receipt of written consent from the Minister for Planning, all affected landowners will be directly notified and a period of public exhibition (community consultation) undertaken to allow the opportunity for written submissions to be made on the draft Amendment.

The period of public exhibition will last for 60 days.

Summary of Draft Planning Scheme Amendment C125well

Draft Planning Scheme Amendment C125well proposes to update the Wellington Planning Scheme by applying updated flood mapping across the municipality, introducing new local land use planning policy provisions and updating the existing Schedules to both the Floodway Overlay (FO) and the Land Subject to Inundation Overlay (LSIO) with updated planning provisions.

The draft Amendment updates the application of the LSIO and FO on flood prone land across the municipality.

Flood studies and technical reports

There are 22 flood studies and associated technical reports which support the proposed draft Amendment. These have been prepared for the East and West Gippsland Catchment Management Authorities (EGCMA and WGCMA), CSIRO and Wellington Shire Council. The Flood Studies and technical reports will be available as part of the community consultation process.

What is draft Planning Scheme Amendment C125well and what does it do?

The draft Amendment has been prepared by Wellington Shire Council (Council) in partnership with (and at the request of) the East Gippsland and West Gippsland Catchment Management Authorities (EGMCA and WGCMA).  

The draft Amendment will:

  • Update the Municipal Planning Strategy relating to environmental risks and amenity.
  • Update the local sections of the Planning Policy Framework (PPF) relating to coastal settlements and floodplain management.
  • Insert new schedules to the Floodway Overlay (FO) and the Land Subject to Inundation Overlay (LSIO) (replace existing).
  • Update and introduce new mapping relating to the Floodway Overlay (FO) and Land Subject to Inundation Overlay (LSIO) (replace existing).  
  • Include changes to the planning controls being applied to land (between LSIO and FO), make changes to the extents of mapping, including increases and reductions to mapped areas.

Where does Draft Planning Scheme Amendment C125well Amendment apply?

Draft Planning Scheme Amendment C125well will update flood mapping across the Wellington Shire – most notably in riverine and coastal areas to accurately identify land assessed as being flood prone.

Why is Draft Planning Scheme Amendment C125well required?

It is a requirement of both state government planning policy and the ‘Victorian Floodplain Management Strategy’, to ensure that flood-prone land is mapped in the Wellington Planning Scheme, including land predicted to be inundated by future sea-level rise, using the most up-to-date data and modelling available.

Wellington Shire Council has a statutory duty to ensure that flood risk and community safety in flood prone areas is appropriately and effectively managed where new development is proposed.

At a Council meeting, Council resolved to seek formal written consent from the Minister for Planning to prepare and give notice of draft Planning Scheme Amendment C125well to the Wellington Planning Scheme. Council also resolved that any unresolved submissions be referred to the Flood‑related Standing Advisory Committee.

A formal application has been made to the Minister for Planning requesting consent to commence the draft Planning Scheme Amendment process.

Step 3: Formal Exhibition

Status: To be advised
A 60‑day public exhibition period will commence. During this time, Council will directly notify all affected landowners about draft Amendment C125well.

Step 4: Consideration of Written Submissions

Status: To be advised
Council will review all written submissions received during the exhibition period. Any submissions that cannot be resolved will be referred to the Flood‑related Standing Advisory Committee.

Step 5: Flood‑related Standing Advisory Committee

Status: To be advised
If required, the amendment will be considered by the Flood‑related Standing Advisory Committee, appointed by the Minister for Planning. The Committee will review unresolved submissions and make recommendations to the Minister before a final decision is made.

Step 6: Decision

Status: To be advised
The Minister for Planning will make a final decision on draft Planning Scheme Amendment C125well. The amendment may be approved, refused or abandoned.

Submissions to draft Planning Scheme Amendment C125well – Public Exhibition Period

Council will directly notify all affected landowners of draft Amendment C125well and begin accepting submissions, during the formal exhibition period.  

Council can accept written correspondence regarding draft Amendment C125well before the formal exhibition period commences, however please note, this correspondence will not be classed as a submission to Amendment C125well, rather ‘for information purposes’ only.  

Flood Mapping Tool

Council is currently preparing a Flood Mapping tool for use by landowners (and other relevant stakeholders). This tool will assist with identifying existing and proposed flood mapping across Wellington Shire. This tool will be made available as part of the community consultation process.
