Notice of Abandonment - Amendment C109 (Part 2)

This Notice has been prepared in accordance with Section 28 (2) of the Planning and Environment Act 1987.

At its ordinary meeting of 4 October 2022, Council resolved to split Planning Scheme Amendment C109 into two separate parts, as follows:

Part 1: consisting of all parts of the exhibited Planning Scheme Amendment (including a restructured planning policy framework and recommendations of the ‘Planning in the Economic Growth Zone’ study) but excluding the proposed deletion of the Environmental Significance Overlay - Schedule 1 (ESO1), from some coastal areas.

Part 2: consisting of the proposed deletion of the Environmental Significance Overlay – Schedule 1 from some coastal areas.

At the meeting Council resolved to adopt and submit C109 Part 1 to the Minister for Planning and to abandon further consideration of C109 Part 2.

Part 2 of the Amendment has been abandoned on the basis that, on balance the perceived benefits associated with the retention of the ESO1, including the protection of native vegetation from unpermitted removal, outweigh a potential reduction in planning permit application numbers.  

Council has adopted C109 Part 1 and requested its formal approval by the Minister for Planning.
