Swimming Pool and Spa Registration

If you own a pool or spa in Wellington Shire Council, it must be registered with Wellington Shire Council prior to 1 June 2020.

Prior to 1 December 2019, Pool and Spa registration with your local Council in Victoria was not mandatory. If your pool or spa was constructed prior to 1 June 2020 it will not be registered, and you are now required to register the pool or spa.

The new laws, introduced by the Victorian Government on 1 December 2019, apply to pools and spas that are capable of holding more than 300mm (30cm) of water. These include:

• Permanent (In-ground) pools
• Above ground pools
• Indoor pools
• Spas and Hot Tubs
• Bathing and wading pools
• Relocatable (moveable or portable) pools that are capable of holding more than 300mm of water for three consecutive days

Registration Fees (Incl. GST)

• Pool or Spa Registration Fee: $31.80
• Information Search Fee (Fee is applicable if you are unable to provide a the Building Permit and Certificate of Final Inspection): $47.20
• Failure to register swimming pool or spa within relevant timeframe: Fine of up to $1,652.20 will be issued

Once a pool or spa is registered, it will remain registered until it is removed from the register. No further registration fees are applicable.

After Registration

Once you have completed the Pool and Spa Registration Form, Council will contact you to advise:

• That your pool or spa has been registered
• The date of construction of your pool or spa and the applicable barrier standard
• Your right to appeal to the Building Appeals Board (BAB) in relation to the Council’s determination of the date of construction of the pool or spa
• The date by which the first or next Certificate of Barrier Compliance must be lodged with Council.

Pool owners will be required to submit a Certificate of Compliance to Council every four years. Council will contact you to advise when your Certificate is due to be submitted.

Certificates of Compliance are available from a registered Building Surveyor.
