Wellington Local Law No 1 - Processes of Municipal Government

The objectives of this Local Law are to:

  • Provide a mechanism to facilitate the good government of the Wellington Shire Council through its formal Processes of Municipal Government (Meeting and Common Seal) Local Law. This is to ensure effective and efficient Council decisions are made in a manner which acknowledges the role of local government within the Australian system of Government
  • Promote and encourage community participation in the system of local government by providing mechanisms for the Council to ascertain the community's views and expectations
  • Regulate and control the conduct of meetings including the notice required for future meetings and the keeping of minutes
  • Provide for the administration of the Council's powers and functions
  • Provide generally for the peace, order and good government of the municipal district

Note: This law is managed by State Government and not by Council.

Local Law 1

Wellington Local Law No 2 - Streets and Roads

The objectives of this Local Law are to:

  • Provide for those matters that require a local law under the Local Government Act 1989 and any other Act
  • Prohibit, regulate and control activities, events, practices and behaviour in places so that no nuisance is caused. Also that there is no detriment to the amenity of the neighbourhood, to a person or to a person’s real or personal property
  • Regulate and control activities on roads in a fair, equitable and safe manner, which does not compromise the primary need for the passage of people and goods
  • Maintain safe and unobstructed passage for pedestrians in line with the Disability Discrimination Act 1992
  • Provide for the administration and exercise of Council powers and functions
  • Provide for the peace, order and good government of the Municipal District of the Wellington Shire
  • Repeal any redundant local laws

Local Law 2

Wellington Local Law No 3 - Municipal Places

The objectives of this Local Law are to:

  • Provide for those matters that require a local law under the Local Government Act 1989 and any other Act
  • Allow and protect the quiet enjoyment by people of municipal places within the Municipal District
  • Enable people in the Municipal District to carry out their day to day activities and to enjoy their recreational pursuits without having their peace and enjoyment interfered with or destroyed
  • Recognise and respond to community expectations relating to the quality of life they expect and require and are capable of influencing
  • Control and prevent behaviour which is a nuisance, or which may be detrimental to health and safety or which affects the enjoyment of recreational or other facilities
  • Protect Council and community assets and facilities on or in municipal places
  • Prohibit, regulate and control: behaviour in municipal places which is harmful or intimidating, behaviour in municipal places which is offensive, dangerous or threatening or which, for other reasons, is inappropriate in a municipal place, and the consumption of alcohol in designated areas and smoking in specified places
  • Provide for the administration and exercise of Council powers and functions
  • Provide for the peace, order and good government of the Municipal District
  • Repeal any redundant local laws

Local Law 3

Wellington Local Law No 4 - Environment

The objectives of this Local Law are to:

  • Provide for those matters that require a local law under the Local Government Act 1989 and any other Act
  • Provide a safe and healthy environment in which the residents of the Municipal District enjoy a quality of life that meets the general expectations of the community
  • Prohibit, regulate and control activities which may be dangerous or unsafe or detrimental to the quality of life in an environment of the Municipal District
  • Control nuisances and noise, odour and smoke emissions, and other discharges to the environment. These factors may adversely affect the enjoyment of life within the Municipal District or the health, safety and welfare of persons within the municipal district
  • Prohibit, regulate and control, in a way which is consistent with the objectives specified within this clause, the following activities and circumstances: smoke emission, particularly emission from burning material and from incinerators; the use of recreation vehicles; fire hazards; dangerous and unsightly land, camping; circuses, carnivals and festivals; animals including animal numbers and the keeping and control of pets and animals; and disposal of waste associated with Municipal Waste Facilities
  • Provide for the administration and exercise of Council powers and functions
  • Provide for the peace, order and good government of the Municipal District of the Wellington Shire
  • Repeal any redundant local laws

Local Law 4

Wellington Local Law No 5 - Livestock

The objectives of this Local Law are to:

  • Provide for those matters that require a local law under the Local Government Act 1989 and any other Act
  • Regulate the movement and droving of livestock through and within the Municipal District and the grazing of livestock within the municipal district
  • Minimise any damage to road pavements, formations, drainage, vegetation and surrounding areas arising from livestock
  • Minimise the spread of livestock disease and noxious weeds in the municipal district
  • Provide for the welfare of livestock when being driven, grazed or moved
  • Alert other road users to the presence on roads of livestock in the Municipal District in the interests of safe use of roads
  • Regulate the adequacy of fencing of livestock
  • Put in place mechanisms for rectifying inadequate fencing
  • Fix fees or charges relating to the impounding of livestock and all other costs incidental thereto and for road use by livestock within the municipal district
  • Provide for the administration and exercise of Council powers and functions
  • Provide for the peace, order and good government of the Municipal District of the Wellington Shire
  • Repeal any redundant local laws

Local Law 5

Penalty for Breach of a Local Law

For a local law, unless the context otherwise requires, 1 penalty unit equals $100.00.  See section 110(2) of the Sentencing Act 1991 for additional information.
