| The need for Amendment C55 to the Wellington Planning Scheme has come about as a result of the Rural Zones Review which was completed in 2009. | |
| Rezoning | | As part of Amendment C55, approximately 70 parcels of land in the Wonnangatta Valley and Dargo River Valleys proposed to be changed from Rural Conservation Zone to Farming Zone.
The Department of Sustainability and Environment’s practice note Applying the Rural Zones states that “The Farming Zone is primarily concerned with keeping land in agricultural production and avoiding land uses that could limit future farming or constrain agricultural activities” and that the “Rural Conservation Zone is primarily concerned with protecting and conserving rural land for its environmental features or attributes.”
The Farming Zone more accurately reflects the current use of the land, such as land now used for orchards and grazing. The properties which have been identified to remain in the Rural Conservation Zone are predominantly covered with native vegetation.

| Special Water Supply Catchment Areas | | Among other recommendations, the Rural Zones Review identified that the protection of potable (fit to drink) water supplies as a key objective. Wellington Shire has six of Victoria’s 143 declared Special Water Supply Catchment Areas which supply potable water for domestic, industrial and agricultural purposes. Development and works which may pollute potable water need to be controlled to ensure the purity of these water supplies.
Amendment C55 proposes to introduce Schedule 8 to the Environmental Significance Overlay (ESO8) to all areas within a declared Special Water Supply Catchment Area (under the Catchment and Land Protection Act 1994). Special Water Supply Catchment Areas are declared by the State Government and identify areas which supply clean, drinkable water for domestic, industrial and agricultural uses. Through the application of the ESO8, Council, along with water authorities, are seeking to further protect these important water supplies.
The practical effect of the ESO8 is to trigger the need for a planning permit to be obtained for some forms of new development ot ensure that water quality and quantity issues are appropriately managed in declared Special Water Supply Catchment Areas (SWSCAs). The ESO8 does not prohibit development.
The application of the ESO8 will ensure all parties are aware from the outset that land is within a SWSCA and that there may be specific requirements if landholders want to subdivide, build or carry out works on their property.
