Amendments C85/C88

Status Update

Planning scheme amendments C85 and C88 and the associated Planning Permits P124/2013 and P373/2012 were approved by the Minister for Planning, Richard Wynne, on Thursday 24 March 2016.  Council formally adopted the amendments at its meeting on 21 July 2015.

Amendment C85 and C88 Proposed Residential Development - Stevens Street, Sale

Council has received two private combined rezoning and planning permit application requests for Stevens Street, Sale (see image below).

The subject land is situated in a prominent location on the southern edge of the township and is adjacent to a designated Ramsar wetland. The adopted ‘Sale, Longford and Wurruk Structure Plan (3MB)’, which is a component of the Wellington Planning Scheme, has identified this land for urban expansion.

Request C85-P124/2013 is located opposite 37-39 and 41 Stevens Street and proposes to:

  • rezone the subject land from Farming Zone (FZ) to Neighbourhood Residential Zone Schedule 1 (NRZ1);
  • apply a Design and Development Overlay Schedule 22 (DDO22);
  • correct the Land Subject to Inundation Overlay (LSIO) to the 3.2m AHD contour;
  • subdivide the land above the 3.2m AHD contour into two lots for residential development; and
  • retain land below 3.2m AHD contour as a separate lot in the FZ.

Request C88-P373/2012 is located on 74 Stevens Street and proposes to:

  • rezone the subject land from FZ to NRZ1;
  • apply a Design and Development Overlay Schedule 22 (DDO22);
  • correct the LSIO to the 3.2m AHD contour;
  • subdivide the land above the 3.2m AHD contour into nine residential lots; and
  • consolidate the land below the 3.2m AHD to prevent a land-locked lot and retain it within the FZ.

 In response to issues raised in the submissions, further information has been provided in relation to:

1)    The location of the proposed pumping station at 74 Stevens Street and the consequential impacts on the proposed subdivision layout.  An update (2MB) to the subdivision plan and planning permit conditions is proposed.

2)    The stability of the subject. Geotechnical Reports (5MB) are prepared which conclude that the subject land is capable of being developed.
