Amendment C95

Status Update

At its meeting of 15 March 2016, Council formally adopted Amendment C95 as recommended by the independent Planning Panel. Council also resolved to request the Minister for Planning to rezone additional land for rural residential purposes within Precincts 5, 6 and 7. 

Planning Scheme Amendment C95 was formally approved by the Minister for Planning on Thursday 9 June 2016 – but excluding the rezoning of the additional land requested by Council.

In response to the Minister’s decision not to rezone the additional land, the matter of further strategic planning work in Port Albert was considered by Council at its meeting of 21 June 2016.  At the meeting, Council resolved to take no further action to rezone additional land in Port Albert at this point in time, having regard to the Council resolution of 2 December 2014, which stated that:

“Should strong growth rates of rural residential lots be evident in Port Albert (following the rezoning of land identified in this motion), Council will review the potential for further rural residential rezoning in the context of the relevant planning policy applicable at the time.”

 

Amendment C95 - Port Albert Rural Residential Lifestyle Lots Review and Planning Controls Review Implementation

Background

The Port Albert Rural Residential Lifestyle Lots Review was adopted by Council on 2 December 2014. Planning Scheme Amendment C95 seeks to implement the recommendations identified in the Final Recommendations Report into the Wellington Planning Scheme. The Amendment also seeks to implement the short term recommendations of the Port Albert Planning Controls Review (4MB) which was completed in June 2014.

The focus of the approved Amendment is to:

  • Create rural living opportunities by rezoning land immediately surrounding Port Albert for Rural Residential purposes.
  • Make changes to the existing policies and controls applying to Port Albert that will reduce red tape and improve planning processes in Port Albert.
  • Rezone the Seabank Caravan Park in recognition and support of the significance of the site as a key asset to the town.
  • Correct a number of zoning anomalies
